นโยบายคุ้มครองข้อมูลส่วนบุคคล (Privacy Policy)

FENIX INTELLEGENT CO., LTD., (ซึ่งต่อไปนี้จะเรียกรวมกันว่า "บริษัทฯ") ผู้ให้บริการเกมออนไลน์ ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล (Data Controller) ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ.2562 และตามกฎหมายอื่นที่เกี่ยวกับการคุ้มครองข้อมูลส่วนบุคคล ตระหนักเป็นอย่างยิ่งต่อทั้งภารกิจสำคัญในการปกป้องคุ้มครองข้อมูลส่วนบุคคลของผู้ใช้บริการ ในฐานะเจ้าของข้อมูลส่วนบุคคล และการปฏิบัติตามพันธะหน้าที่ต่าง ๆ ตามที่บัญญัติไว้ในกฎหมาย โดยคำนึงถึงคุณภาพของผลิตภัณฑ์และการให้บริการที่มีต่อผู้ใช้บริการ เพื่อดูแลและให้บริการผู้ใช้บริการทุกท่านอย่างดีที่สุด บนพื้นฐานความพึงพอใจอย่างมากที่สุดของผู้ใช้บริการ ด้วยเจตจำนงอันมุ่งมั่นอย่างแรงกล้าดังกล่าว บริษัทฯ ขอประกาศนโยบายคุ้มครองข้อมูลส่วนบุคคล ดังนี้

1.ข้อมูลที่บริษัทฯ เก็บรวบรวมจากการใช้บริการของผู้ใช้บริการ

ข้อมูลที่เก็บรวบรวม คือ ข้อมูลส่วนบุคคลของผู้ใช้บริการ และข้อมูลจากการใช้บริการของผู้ใช้บริการ

2.ขอบเขตของการเก็บรวบรวมข้อมูล บริษัทฯ

จะเก็บรวบรวมข้อมูลเท่าที่จำเป็นต้องใช้ในการประมวลผล ภายใต้วัตถุประสงค์โดยชอบด้วยกฎหมายในฐานะผู้ควบคุมข้อมูลส่วนบุคคล

3.วัตถุประสงค์ของการประมวลผลข้อมูล วัตถุประสงค์ของบริษัทฯ

ในการประมวลผลข้อมูล คือ เพื่อทราบและเข้าใจถึงพฤติกรรมการใช้บริการของผู้ใช้บริการได้ดียิ่งขึ้น และเพื่อการเสนอผลิตภัณฑ์ต่างๆ และการให้บริการใ นรูปแบบที่หลากหลาย อย่างดีที่สุดและเหมาะสมที่สุด ให้แก่ผู้ใช้บริการ และเพื่อให้การดังกล่าวนี้สัมฤทธิ์ผล บริษัทฯ อาจใช้เครื่องมือบางประการ เช่น “Cookies” ในการเก็บรวบรวมและประมวลผลข้อมูล

4.การใช้สิทธิของผู้ใช้บริการในการขอให้บริษัทฯ

ลบข้อมูลส่วนบุคคลหรือข้อมูลการใช้บริการ ของผู้ใช้บริการ ผู้ใช้บริการมีสิทธิและสามารถใช้สิทธิขอให้บริษัทฯลบข้อมูลส่วนบุคคลหรือข้อมูลการใช้บริการ ของผู้ใช้บริการ หรือทำให้ข้อมูลนั้น เป็นข้อมูลที่ไม่สามารถระบุตัวบุคคลที่เป็นเจ้าของข้อมูลส่วนบุคคลได้ ในกรณีที่

ข้อมูลนั้นหมดความจำเป็นในการเก็บรักษาไว้ตามวัตถุประสงค์ในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูล

เมื่อผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล เพิกถอนการให้ความยินยอมในการเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลส่วนบุคคล และบริษัทฯในฐานะผู้ควบคุมข้อมูลส่วนบุคคล ไม่มีอำนาจหรือความชอบธรรมตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลนั้นต่อไปได้

5.กรณีอื่นนอกจากนี้ เป็นไปตามที่ระบุไว้ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ.2562 มาตรา 33

อำนาจหรือความชอบธรรมตามกฎหมายที่จะเก็บรวบรวม ใช้ หรือเปิดเผยข้อมูลนั้นต่อไปได้ ย่อมเป็นไปตามสิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

6.สิทธิต่างๆ ของผู้ใช้บริการ ในฐานะเจ้าของข้อมูลส่วนบุคคล ที่พึงได้รับการปกป้องคุ้มครอง

เพื่อตอบแทนผู้ใช้บริการในฐานะที่ผู้ใช้บริการเป็นผู้สนับสนุนผลิตภัณฑ์ของบริษัทฯ และเพื่อให้เป็นไปตามสิทธิของเจ้าของข้อมูลส่วนบุคคล อันได้รับการบัญญัติปกป้องคุ้มครองไว้ในกฎหมาย บริษัทฯ คำนึงถึงการปกป้องคุ้มครองสิทธิของผู้ใช้บริการในฐานะที่ผู้ใช้บริการเป็นเจ้าของข้อมูลส่วนบุคคล ด้วยตระหนักว่าเป็นสิทธิพื้นฐานที่พึงมีและพึงใช้ได้ของผู้ใช้บริการ สิทธิต่างๆ ของผู้ใช้บริการ ในฐานะเจ้าของข้อมูลส่วนบุคคล ที่พึงได้รับการปกป้องคุ้มครองจากบริษัทฯ มีดังต่อไปนี้

ผู้ใช้บริการ ในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิที่จะได้รับการแจ้งถึงวัตถุประสงค์ของการเก็บรวบรวม การใช้ และการเปิดเผยข้อมูลส่วนบุคคล

ผู้ใช้บริการ ในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิที่จะให้การอนุญาต หรือเพิกถอนการอนุญาต สำหรับการเก็บรวบรวมข้อมูล ณ เวลาใดๆ ได้โดยอิสระ ภายใต้สิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

ผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิขอเข้าถึง และ/หรือ ได้รับ ข้อมูลส่วนบุคคลของตนเอง

ผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิขอให้ลบ หรือทำลาย ข้อมูลส่วนบุคคลของตนเองได้ ภายใต้สิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

ผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิขอให้การเก็บรวบรวมข้อมูลส่วนบุคคลของผู้ใช้บริการ เป็นไปโดยถูกต้อง สมบูรณ์ เป็นปัจจุบัน และไม่ก่อให้เกิดความเข้าใจผิด

ผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล พึงมีสิทธิขอให้ส่งหรือโอนข้อมูลส่วนบุคคลของตนเอง ไปยังผู้ควบคุมข้อมูลส่วนบุคคลอื่นได้ ภายใต้สิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

7.วิธีการปกป้องคุ้มครองข้อมูลส่วนบุคคล

บริษัทฯ ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล จะพึงจัดให้มีและใช้มาตรการรักษาความปลอดภัยที่เหมาะสม เพื่อป้องกันการสูญหาย เข้าถึง ใช้ เปลี่ยนแปลง แก้ไข หรือเปิดเผยข้อมูลส่วนบุคคล โดยปราศจากอำนาจหรือโดยมิชอบ และพึงทบทวนมาตรการดังกล่าวเมื่อมีความจำเป็นหรือเมื่อเทคโนโลยีเปลี่ยนแปลงไป เพื่อให้มีประสิทธิภาพในการรักษาความมั่นคงปลอดภัยที่เหมาะสม

8.ระยะเวลาในการเก็บรักษาข้อมูลส่วนบุคคล

บริษัทฯ ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล จะเก็บรักษาข้อมูลส่วนบุคคลของผู้ใช้บริการไว้ ตลอดระยะเวลาที่ผู้ใช้บริการยังคงใช้บริการผลิตภัณฑ์ของบริษัทฯ จนกว่าผู้ใช้บริการจะเพิกถอนความยินยอมให้จัดเก็บข้อมูลส่วนบุคคลของผู้ใช้บริการ หรือจนกว่าผู้ใช้บริการจะใช้สิทธิขอให้ลบ หรือทำลายข้อมูลส่วนบุคคลของผู้ใช้บริการ ภายใต้สิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

9.กรณีที่มีการละเมิดข้อมูลส่วนบุคคล

ในกรณีที่มีการละเมิดข้อมูลส่วนบุคคล ซึ่งมีความเสี่ยงสูงที่จะมีผลกระทบต่อสิทธิและเสรีภาพของบุคคล บริษัทฯ ในฐานะผู้ควบคุมข้อมูลส่วนบุคคล จะดำเนินการแจ้งหรือติดต่อหรือรับการติดต่อประสานงานจากผู้ใช้บริการในฐานะเจ้าของข้อมูลส่วนบุคคล พร้อมกับแนวทางการเยียวยา โดยไม่ชักช้า ภายใต้สิทธิ หน้าที่และความผูกพัน ระหว่างคู่สัญญา และ/หรือ ภายใต้บทบัญญัติแห่งกฎหมาย

10.ผู้ใช้บริการสามารถติดต่อกับบริษัทฯ ได้อย่างไร

ผู้ใช้บริการสามารถติดต่อกับบริษัทฯ ได้ทุกช่องทาง ตามที่บริษัทฯ ได้แจ้งไว้ และเปิดให้ติดต่อได้ เช่น โดยทางระบบ Customer Service โดยทางที่อยู่สำนักงานของบริษัทฯ เป็นต้น รวมถึงช่องทางอื่น ๆ นอกเหนือจากนี้ตามที่ปรากฏ ไม่ว่าโดยตรงหรือโดยปริยายก็ตาม ทั้งนี้ ผู้ใช้บริการจะสามารถติดต่อได้โดยง่าย

FENIX INTELLEGENT CO., LTD., hereinafter collectively referred to as the “Company,” are providers of online game services and act as a Data Controller under the Personal Data Protection Act B.E. 2562 and other laws relating to personal data protection.

The Company is fully aware of its important duty to protect the personal data of service users, as data subjects, and to comply with all obligations prescribed by law. The Company takes into account the quality of its products and services provided to users in order to care for and serve all users in the best possible way, based on the highest level of user satisfaction. With this strong commitment, the Company hereby announces its Privacy Policy as follows:

1. Data collected by the Company from users’ use of services

The collected data includes users’ personal data and data arising from users’ use of the services.

2. Scope of data collection

The Company will collect only the data necessary for processing under lawful purposes in its capacity as the Data Controller.

3. Purposes of data processing

The Company processes data in order to better know and understand users’ service usage behavior, and to offer various products and services in the best, most diverse, and most appropriate forms to users. To achieve these purposes, the Company may use certain tools, such as “Cookies,” to collect and process data.

4. Users’ right to request deletion of personal data or service usage data

Users have the right to request that the Company delete their personal data or service usage data, or anonymize such data so that it can no longer identify the data subject, in the following cases:

When the data is no longer necessary to retain for the purposes for which it was collected, used, or disclosed.

When the user, as the data subject, withdraws consent for the collection, use, or disclosure of personal data, and the Company, as the Data Controller, no longer has lawful authority or legal justification to continue collecting, using, or disclosing such data.

5. Other cases

Other cases shall be as specified under Section 33 of the Personal Data Protection Act B.E. 2562 (2019).

The Company’s authority or legal justification to continue collecting, using, or disclosing such data shall be subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

6. Rights of users as personal data subjects

In recognition of users as supporters of the Company’s products, and in accordance with the rights of data subjects protected by law, the Company respects and protects users’ rights as owners of their personal data. The Company recognizes these rights as fundamental rights that users should have and be able to exercise.

Users, as personal data subjects, are entitled to the following rights:

Users have the right to be informed of the purposes of collecting, using, and disclosing personal data.

Users have the right to give consent or withdraw consent for data collection at any time freely, subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

Users have the right to request access to and/or obtain their own personal data.

Users have the right to request deletion or destruction of their own personal data, subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

Users have the right to request that their personal data be collected accurately, completely, currently, and without causing misunderstanding.

Users have the right to request that their personal data be sent or transferred to another Data Controller, subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

7. Methods for protecting personal data

The Company, as the Data Controller, shall provide and implement appropriate security measures to prevent the loss, unauthorized access, use, alteration, correction, or disclosure of personal data without lawful authority or unlawfully. The Company shall review such measures when necessary or when technology changes, in order to maintain appropriate and effective data security.

8. Period of personal data retention

The Company, as the Data Controller, will retain users’ personal data for as long as users continue to use the Company’s products, until users withdraw consent for the collection of their personal data, or until users exercise their right to request deletion or destruction of their personal data, subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

9. In the event of a personal data breach

In the event of a personal data breach that poses a high risk of affecting the rights and freedoms of individuals, the Company, as the Data Controller, will notify, contact, or coordinate with users as personal data subjects, together with remedial measures, without delay, subject to the rights, duties, and obligations between the contracting parties and/or applicable legal provisions.

10. How users can contact the Company

Users may contact the Company through all channels announced and made available by the Company, such as the Customer Service system, the Company’s office address, and other channels that may appear, whether directly or indirectly. Users shall be able to contact the Company easily.
